Terms and Conditions

General Terms and Conditions (GTC) of Taunusgitarre e.V.

​

1. Scope These General Terms and Conditions (GTC) apply to all business activities of Taunusgitarre e.V., particularly for the commissioning and remuneration of artists, the conclusion of cooperation agreements with concert halls, and the organization of paid courses and workshops.

 

2. Contract Conclusion A contract with the association is concluded through a written agreement or an explicit declaration of acceptance. This applies in particular to:

  • Contracts with artists for performances or other services,

  • Cooperation agreements with concert organizers and venues,

  • Registrations for courses and workshops.

 

3. Commissioning of Artists (1) The association may commission artists to provide artistic services. The details of the collaboration, particularly remuneration, service provision, and rights to the delivered services, are contractually regulated. (2) Remuneration is provided according to a separate agreement and in compliance with tax regulations. (3) The artist assures that they are authorized to perform the agreed service and do not infringe upon third-party rights.

 

4. Cooperation with Concert Halls and Organizers (1) The association may enter into cooperation agreements with concert halls or event organizers. These agreements regulate, among other things, the use of facilities, technical equipment, cost sharing, and liability. (2) The association is not liable for defects or damages caused by the venue operator.

 

5. Participation in Courses and Workshops (1) Registration for courses and workshops is binding and must be made in writing or online. (2) The participation fee must be paid before the start of the event. (3) If the participant cancels, the following refund policies apply:

  • Up to 14 days before the event: 100% refund,

  • Up to 7 days before the event: 50% refund,

  • Less than 7 days before the event: No refund. (4) The association reserves the right to cancel courses or workshops due to low participant numbers or organizational reasons. In such cases, any fees paid will be fully refunded.

 

6. Payment Terms (1) Unless otherwise agreed, invoices issued by the association are payable within 14 days of issuance without deductions. (2) Payments must be made via bank transfer to the account specified in the invoice. (3) In case of late payment, the association reserves the right to charge statutory default interest.

 

7. Liability Disclaimer (1) The association is liable only for intent and gross negligence. Any further liability is excluded to the extent permitted by law. (2) The association assumes no liability for material or personal damages occurring during courses, workshops, or events unless caused by gross negligence or intent on the part of the association.

 

8. Data Protection (1) Personal data of contractual partners and participants will be used solely for contract execution and communication. Data will not be shared with third parties unless required by law. (2) Further details can be found in the association's privacy policy.

 

9. Jurisdiction (1) For disputes with businesses or legal entities under public law, the place of jurisdiction is Königstein, as far as legally permissible. (2) For disputes with consumers, the statutory place of jurisdiction applies.

 

10. Final Provisions (1) The law of the Federal Republic of Germany applies. (2) Should any provision of these GTC be or become invalid, the validity of the remaining provisions remains unaffected.
